1. Acceptance of terms
By accessing or using binaryandbricks.com ("Website"), our mobile applications, software products or services (collectively, the "Services") provided by Binary & Bricks Pvt Ltd ("Binary & Bricks", "we", "us" or "our"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Services.
2. About our Services
Binary & Bricks provides digital marketing, custom software, mobile app development, branding, real estate marketing and construction technology solutions to builders, developers and businesses. The specific scope of any paid engagement is documented in a signed proposal, statement of work or invoice.
3. Use of the Website & apps
- You must be 18 years or older to use our Services on behalf of a business.
- You agree not to attempt to access, reverse-engineer, scrape, or interfere with our Website, apps, servers or infrastructure.
- You agree not to use our Services for any unlawful, fraudulent or harmful purpose.
- We may suspend or terminate access if these terms are violated.
4. Engagements and fees
All paid work is governed by a separate proposal or statement of work that defines scope, deliverables, timelines, fees and payment terms. In the absence of a signed agreement, our standard payment terms apply: 50% advance and balance against milestones or completion, payable within 7 days of invoice.
All fees are exclusive of applicable taxes (GST, withholding tax etc.) which will be charged additionally.
5. Intellectual property
5.1 Our IP
All content on the Website — including the Binary & Bricks name, logo, app icons, designs, articles, code, frameworks and reusable components — is owned by or licensed to us. You may not reproduce, distribute or create derivative works without our written permission.
5.2 Client IP
For paid engagements, on full payment of agreed fees, the deliverables created exclusively for you (code, designs, content) are owned by you, subject to (a) our retained ownership of any pre-existing tools, libraries, frameworks and components we use, and (b) our right to reference the work in our portfolio with reasonable confidentiality.
6. Mobile applications
Our mobile apps (Construction Calculator A1, Construction Expert A1 PRO, Steel BBS Calculator, etc.) are provided "as is". Calculations, estimates and data presented in the apps are intended as engineering aids and must be independently verified by a qualified professional before being used in design, procurement or site decisions. Binary & Bricks is not liable for losses arising from reliance on app outputs.
7. Third-party services
The Website and apps may link to or integrate with third-party services (Google Play Store, Apple App Store, Meta Ads, Google Ads, WhatsApp etc.). Your use of those services is governed by their respective terms. We are not responsible for their content, performance or availability.
8. Disclaimers
The Website and Services are provided on an "as is" and "as available" basis. We make no warranties — express or implied — regarding fitness for a particular purpose, uninterrupted availability, or error-free operation. Industry performance benchmarks shown on the Website (e.g. cost-per-lead, ROAS, conversion rates) are based on past results and are not a guarantee of future outcomes.
9. Limitation of liability
To the maximum extent permitted by law, Binary & Bricks, its directors, employees, partners and suppliers shall not be liable for any indirect, incidental, special, consequential or punitive damages — including lost profits, lost data or business interruption — arising from your use of, or inability to use, the Services. Our total aggregate liability for any claim arising out of an engagement shall not exceed the fees paid by you for that specific engagement in the 12 months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless Binary & Bricks against any claims, damages or expenses arising from (a) your misuse of the Services, (b) your violation of these Terms, or (c) your violation of any law or third-party right.
11. Confidentiality
Both parties agree to keep confidential any non-public business, technical or financial information shared during the engagement. This obligation survives termination of the engagement.
12. Termination
Either party may terminate an engagement in writing with the notice period stated in the signed proposal. Upon termination, you remain liable for fees corresponding to work completed up to the termination date.
13. Governing law and jurisdiction
These Terms are governed by the laws of India. Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Pune, Maharashtra, India.
14. Changes to these Terms
We may update these Terms from time to time. The most recent version will always be available at this URL. Continued use of the Services after changes means you accept the revised Terms.
